Japan's Kaieda ahead in PM race but run-off likely (Reuters)

TOKYO (Reuters) ? Japanese Trade Minister Banri Kaieda has the lead in a ruling party race to pick the next prime minister, but a bruising run-off looks likely as chances of a majority win in a first-round vote are slim, media surveys showed Sunday.

Japan's sixth prime minister in five years faces huge challenges -- a resurgent yen that threatens exports, forging a new energy policy while ending the worst nuclear crisis since Chernobyl, finding funds to rebuild from a devastating March tsunami as well paying for the ballooning social welfare costs of a fast-aging society.

The obstacles to governing, including a divided parliament and internal party bickering, have raised concerns that the next premier, to be selected in a Democratic Party of Japan (DPJ) vote Monday, will end up being another short-lived leader.

"Unfortunately, chances are that whoever wins, we'll be going through the same debate in 12 months," said Jesper Koll, director of equities research at JP Morgan in Tokyo.

The 62-year-old Kaieda, who has secured Ozawa's backing, had support from about 115 of the 398 Democratic lawmakers eligible to vote in Monday's party election, a survey by the Mainichi newspaper showed.

NHK public TV said Ozawa's group was growing confident of winning a second vote, an outcome that could unnerve investors worried about Japan's bulging debt given his cautious stance on raising taxes to pay for rebuilding from the tsunami and calls for the Bank of Japan to do more to support the economy.

RUN-OFF LIKELY, LAGGARDS JOCKEY

Former foreign minister Seiji Maehara, 49, who says beating deflation is a top priority and also wants the Bank of Japan to do more, was jostling with fiscal hawk Finance Minister Yoshihiko Noda, 54, and little-known Farm Minister Michihiko Kano, 69, for second place.

A fifth candidate, former transport minister Sumio Mabuchi, 51, was lagging well behind.

If no candidate wins a majority in an initial vote, a run-off will immediately be held between the two top candidates.

The winner of the DPJ election will become prime minister by virtue of the party's majority in parliament's lower house.

Maehara ranks highest of the candidates with ordinary voters, but his chances have been undercut by rivalry with Noda, who shares a similar support base inside the DPJ, as well as by concern about a donations scandal.

Maehara -- who would become Japan's youngest post-World War Two premier if he wins -- resigned as foreign minister in March after admitting he had accepted donations from a Korean resident of Japan. That would be illegal had he done so knowingly.

Saturday, he told a news conference he had received more than $7,000 in donations from four foreigners and one firm headed by a foreigner between 2005 and 2010, but had not been aware of the donations, Japanese media reported.

Whoever takes over from outgoing Prime Minister Naoto Kan, who resigned as party head Friday after months of criticism for his handling of the nuclear crisis, faces a struggle to implement policies in a "twisted" parliament where opposition parties control the upper house and can block bills.

Maehara and Noda Sunday reiterated their calls for a "grand coalition" with the main opposition parties. Kaieda rejected the idea, to which opposition rivals have anyway been cool. "In a democratic parliamentary system, a grand coalition is not preferable," he said in a debate on NHK public TV.

Feuds over the role of Ozawa, a one-time heavyweight in the conservative Liberal Democratic Party who bolted and helped briefly oust the long-dominant party in 1993, have rattled the Democrats since his Liberal Party merged with the DPJ in 2003.

Some credit his political skills with engineering the Democrats' leap to power in an August 2009 election. Others say his scandal-tainted image is damaging the party, which has seen its support sink among voters disillusioned with its failure to deliver on promises of bold changes in how Japan is governed.

Trademark Lawsuit Defense: We Aren't Nearly As Good | Extreme ...

When confronted with an Apple lawsuit alleging trademark violations for logo merchandise and a Flushing (NY) store named ?Apple Story,? the defendants had a quick explanation: they weren?t located in quality malls?like Apple stores, didn?t have experienced and knowledgeable personnel, had no Genius Bars, didn?t have award-winning architecture, and had not become attractions like Apple. In fact, the attorney for defendants Janice Po Chiang and Jimmy Kwok claimed, Apple?s sophisticated customers would never mistake his clients? stores for an Apple store. Instead, they would ?do a double-take? and conclude it was something much less. But on July 25, 2011 U.S. District Court Judge Kiyo Matsumoto disagreed with the defendants? argument and issued a temporary restraining order against Chaing and Kwok, ending their sales of various protective cases bearing Apple?s trademarks. He also ordered U.S. Marshals to assist Apple?s investigators in searching two homes and two retail stores, and in seizing any items they found that infringed Apple?s trademark. While Apple?s legal case was primarily based on the defendants? alleged import and sales of?iPod, iPhone and iPad cases that bore the ?bite of Apple? logo, it was bolstered by the fact that Chiang and Kwok were selling the items from an ?Apple Story.?

Apple became aware of the defendants? Apple Story and Fun Zone retail stores in the suburbs of New York City earlier this year, and learned they were selling products that bore Apple?s name and logo. The company sent undercover investigators to purchase products over a period of time, and discovered the products were counterfeits.
The company took its findings to attorneys, who prepared and filed documents with the U.S. District Court, Eastern District of New York. They asked for an injunction, a restraining order and the right to search certain properties and seize counterfeit merchandise. They asked the judge to seal the lawsuit filing so the defendants would not find out and possible destroy evidence.
Much of Apple?s lawsuit filing is background material on the company?s history, its famous Apple logo and branding in general. The filing notes Apple operates over 300 stores which have become ?attractions.? The company has trademarks on the logo and various words, including ?iPod,? ?iPhone? and ?Apple Store.? The trademarked words??APPLE STORE? not only are ?inherently distinctive, but have acquired distinctiveness and are famous,? the lawsuit states. (In its legal filings, Apple?s attorneys always put the words ?Apple Store? in all-caps, while the defendants capitalize only the first letter of each word.)
The remainder of Apple?s filing outlined how its lawsuit fulfills the federal trademark violation proof requirements, a seven-step process. The company?s attorneys?whose offices are a mere six blocks from Apple?s Fifth Avenue (NYC) retail store?also explained why Apple was elegible for a temporary restraining order and preliminary injunction against the defendants, ordering them to stop selling the merchandise and to hand over any counterfeit items.
?Defendants? APPLE STORY mark incorporates all of Apple?s APPLE mark and it differs from Apple?s APPLE STORE mark by only one letter.? ? Apple
?Defendants sell counterfeit Apple accessories in a store they have name ?APPLE STORY,?? the lawsuit states. ?Their intent to associate their store with Apple and Apple?s APPLE STORE retail locations is obvious.? Apple?s attorneys argued to the court, ?By naming a store selling counterfeit Apple products ?APPLE STORY,? Defendants intend consumers to associate their store and counterfeit products with Apple.?
Apple asked for a expedited process of discovery, involving obtaining documents and taking depositions from the defendants. They also requested that the lawsuit be filed under seal so as not to tip off the defendants who, Apple argued, might destroy evidence if they learned of the lawsuit.
In the June 25, 2011 order granting a temporary restraining order, Judge Matsumoto prohibited the defendants from using ?Apple or ?Apple Story? in any way, ?or any names or marks confusingly similar?as a store name.? He also the search of several premises and the seizure of any counterfeit products.
During an August 4, 2011 hearing, the defendants agreed to the conditions of the restraining order and injunction, and to cooperate with Apple?s investigation of the trademark violations, including handing over documents.
Private Eye Investigates
Apple hired a former New York City police officer and now private investigator to confirm its suspicions that the defendants were selling counterfeit Apple products. Jame Ricaurte filed a declaration in the lawsuit that said he visited the APPLE STORY on Main Street in Flushing (NY), and so did several of his investigators on ?multiple occasions.?
Ricaurte said he and the others saw the APPLE STORY sign, the Apple logo on products, and made several purchases. The products were shipped back to Apple?s headquarters in Cupertino (Calif.), where employees confirmed the products were not made by Apple and were otherwise not authorized to be made.
Ricaurte?s investigators also followed Chiang and Kwok, determining that they were obtaining product stock for their two stores from two residential homes, one in College Point (NY) and another in Whitestone (NY). Later, U..S. Marshals and Apple?s investigators would raid those homes and find boxes of counterfeit products. According to Apple, the product shipping boxes indicated that the items originated in China.
Apple?s Senior Manager of Investigations for the Americas, Adrian Punderson, also filed a declaration in the case, saying he received Ricaurte?s packages of products from the Apple Story store, and confirmed they were not Apple merchandise.
A third declaration was filed from Thomas R. La Perle, an intellectural property attorney working for Apple. He provided much of the background material on Apple?s brand, its logos and trademarks, and the legal protections to which they?re entitled. Le Perle included pages of trademarks documents, screen grabs from the Internet to support the company?s claims of trademark violation.
Defendant?s Position
Perhaps the most interesting material among the 400 of legal documents is the response of the defendants, who invoked the recent stories of counterfeit Apple stores in China and automotive tychoon Henry Ford. They also complained several times that Apple?s investigators had seized products with no Apple logo, only because the instruction papers inside the product box had an Apple logo printed on it.
Attorney Samuel Chuang began his response to the lawsuit by saying the defendants, ?are not saying to its customers that it is selling Plaintiff?s or Plaintiff?s sponsored or endorsed products.? And then oddly, Chuang said that Apple doesn?t even make its own product cases, but has other companies make them for Apple.
He claimed that Apple had been marketing products using Henry Ford?s principal of, ?Any customer can have a car painted any colour (sic) that he wants so long as it is black.? Chuang claimed, ?The vacuum of diversity and protection spawned the market of personalized, protective cases for the Apple devices, a market Plaintiff has not entered.?
As for the name of the store, Chuang had a thin explanation. The name ?Apple Story? began ?in thought? as ?Your @pple Story,? he said, ?Where the customer can tell his or her ?story? by customizing the expensive and much prized iPhone with decorations including studs, pictures, and color, as well as protect the iPhone??
While searching for business partners, the defendants contemplated using the name ?Lucky Leaf @pple Story, Chuang said. But the partnership didn?t work out.
?When it came time for the Defendants to actually form a company, create a logo, and make a sign? Chuang wrote in the filing, ?the ?@? was replaced with ?A? because the logo ?@S? was too confusing, and the ?AS? logo was created.?
Chuang admitted Apple?s trademark on ?Apple Store,? but said, ?None of Plaintiff?s brick and mortar retail storefronts, which themselves have become attractions, use the service mark ?APPLE STORE.? Instead, Apple?s stores are identified ?only and simply? by a silver apple with a bite on the right side. The defendants? lawsuit filing included photos of several Apple retail stores bearing a white, back-lit Apple logo, but without the trademarked words, ?Apple Store.?
?None of Defendants? businesses are in high-traffic locations in quality shopping districts; none are designed to simplify and enhance the presentation and market for Plaintiff?s products and related solutions?? ? Defendants
Chuang concluded that Apple?s ?Apple Store? trademark doesn?t merit trademark protection. ?While it is undisputed that the Apple logo is famous and widely known, the word ?APPLE? without context is less so, and the unadorned words ?APPLE STORE? much less so.? He pointed out, ?Somehow, Plaintiff thought it was enough to identify the establishment with a perfectly centered and suspected Apple logo and not need the surplusage ?APPLE STORE.??
He said that the words ?Apple Story? weren?t likely to cause consumer confusion. ?Plaintiff makes much ado about how ?Apple Story? and ?APPLE STORE? differ my (sic) only one letter,? Chaung wrote. ?However, one letter makes a difference; a store is a place where one goes to purchase merchandise, usually on a retail basis, howver, a story is an idea that is design to interest, amuse, or perhaps instruct the storyteller or listener.?
People visit an Apple store to purchase Apple products, Chuang explained. ?But at ?Apple Story? one goes to search for interesting or amusing accessories to express his or her story.? The addition of a graphic logo in front of the words also differentiates the defendants? store, he said.
Chuang also ripped off several more defenses, including that the ?APPLE STORE? trademark is not a ?strong mark,? that the two versions are ?not sufficiently similar,? that the two companies don?t compete, and that Apple had not provided any evidence of actual consumer confusion.

He continued, ?When these consumers enter Defendant Apple Story?s store, there is no sense that they are in an ?Apple? store; when they see unsophisticated displays that would suggest to them they may not be in an ?Apple? store; when there is no blue-shirted employee with a name tag, or genius bar, and the prices of items have no ?Apple? premium attached to them (i.e., generic prices) such consumers are sophisticated enough to know that they are not in Plaintiff?s retail stores.
?For Plaintiff?s consumers, who are used to seeing Plaintiff?s stores in high-end malls, to even see the Defendants? store would cause them to do a double-take and review the name and logo more closely, and come to the conclusion that Defendants? store is not an Apple? store.?
Apple?s lawsuit is pending, and the company could return to court asking for damages from the defendants or other legal actions, based on what they determine from examining the products they seized.

North Korean leader arrives at Russia-China border (AP)

MOSCOW ? News reports say the North Korean leader's armored train has arrived at the Russian-Chinese border, and he is expected to cross into Manchuria in China's northeast shortly.

The Interfax news agency reported Thursday that Kim Jong Il's train was seen at the Zabaikalsk railway station.

Kim met with Russian President Dmitry Medvedev in the Siberian city of Ulan-Ude on Wednesday and agreed to impose a nuclear test and production moratorium if international talks on Pyongyang's atomic program resume.

The Kremlin said Kim had expressed readiness to return to the talks without preconditions.

Faced with deepening sanctions and economic woes, North Korea has pushed to restart the six-sided talks that involve both Koreas, the United States, China, Russia and Japan.

One of the best ways to increase your sales and one that won't cost you a lot or take a huge amount of time is by selling more to your existing customers. This can be a lengthy process and expensive to win over a new customer. between advertising, sales calls, and approvals. With existing customers the process can be much quicker, smoother, and less costly.

Existing customers already know you and what you can do. Your challenge is to learn about additional opportunities within your company, and go after them.

If the cost of sale for an existing customer is so much lower than for a new customer, why don't small companies go after their existing customers more aggressively?

Because they have been conditioned to grow their customer list, and because they simply may not realize the potential that exists in obtaining repeat sales from existing customers.

Bringing in new customers is sometimes more exciting for sales people than expanding sales to existing customers. Don't interpret this to say that small companies shouldn't aggressively go after new customers. The purpose here is to suggest that substantial growth lies in repeat sales to existing customers.

Stay in touch with existing customers to learn their ongoing needs. Inquire into their challenges so as to discover needs they have that you can fulfill. It may be that someone in another department has a problem that one of your company's products or services can solve. It is only by being in touch with customers that you learn about such opportunities.

Try to find up selling opportunities. Not only more of the same, but larger orders and new features. A satisfied customer is a great candidate for expanded sales. The customer has respect for your capabilities and ability to deliver. The customer will listen to your pitch and likely tell you about possible obstacles.

They will probably tell you about their limited budgets or opposition from another department. They might slip you some information about the existence of a competitor. You are then in a position where you can help solve the problem. Perhaps by offering a quantity discount or throwing in some additional service that will convince others in your company that you should provide more of your products or services.

Let existing customers know when you come out with a new product or service. Regardless of whether they buy, they can provide feedback and may become buyers for the new product down the road.

Seek out leads from existing customers. They can often provide referrals to others in their companies or to individuals associated with other firms they do business with. It always helps in soliciting a prospect to be referred by someone the prospect respects. Existing customers represent a potential gold mine. Not only for the present, but for helping expand your company's future.

UK's Cameron under pressure over cuts after riots (Reuters)

LONDON (Reuters) ? Prime Minister David Cameron risks his government's austerity drive, particularly its plans to cut police funding, becoming the focus of Britons' fears about the future after the worst looting and rioting in decades hit English cities this week.

The Conservative party leader took a hardline approach to the violence on Thursday, vowing "the lawless minority" would be hunted down and punished, and blaming the police for their initial response.

Now that the violence has died down, Cameron is under growing pressure to abandon plans to cut police numbers after trouble spread from the capital to several other cities over four chaotic nights, severely stretching police resources.

The country is divided over what caused the looting and arson, but many fear the reductions in police numbers implicit in the government's deep public spending cuts could leave the country exposed if more trouble erupts.

Community leaders and some commentators say poverty, unemployment and a bitter sense of exclusion among many young people cannot be ignored, and public sector cuts are likely to hit the poorest in society hardest.

Ed Miliband, leader of the opposition Labor party, took care not to blame the government's planned cuts directly for the violence, but told the BBC: "The cuts that are being made are very bad for our society."

Cameron blamed the violence on a minority of opportunistic criminals and on society's failings. "When you have deep moral failures you don't hit them with a wall of money," he told parliament in an emergency debate.

Police chiefs were unimpressed with Cameron's criticism of their officers' initial response. "The police faced an unprecedented situation, unique circumstances," said Hugh Orde, president of the Association of Chief Police Officers.

Orde said "honest conversations" were needed with the government about its spending plans. "It's the 20 percent cuts in the present spending period that will lead to less police officers, we should be very clear about that."

Cameron's center-right Conservatives took power in May 2010 in coalition with the smaller, centrist Liberal Democrats, promising to cut spending to reduce a budget deficit that peaked at more than 10 percent of gross domestic product.

Finance minister George Osborne said on Thursday that Britain's deficit reduction measures were an example to the rest of Europe, but many fear job losses, benefit cuts and reduced services.

Labor, in power for 13 years until May 2010 under Tony Blair and Gordon Brown, have repeatedly said the coalition's planned cuts are too big, too soon, and will stunt the economy.

"The events of the last few days have been a stark reminder to us all that police on our streets make our communities safer and make the public feel safer," Miliband told parliament.

UNEASY PEACE

Britons were appalled at the scenes on their streets, from the televised mugging of a badly beaten Malaysian teenager by people pretending to help him, to a Polish woman photographed leaping from a burning building.

The scale and ferocity of the rioting -- not only in inner-city areas but also in some middle-class suburbs -- battered Britain's image as a civilized and peaceful society.

Footage of looters kicking in shop windows and stealing everything from baby clothes to food and large television sets was repeated for days on rolling news channels around the world.

The unrest flared first in north London after police shot dead a black man and refused to give his relatives information about the incident. A local protest then developed into widespread looting and violence.

But social strains have been growing in Britain for some time, with the economy struggling to clamber out of an 18-month recession, one in five young people out of work and high inflation squeezing incomes and hitting the poor hardest.

Some of the looters spoke of taking a stand against "the system" and picked out the recent scandal of lawmakers' fraudulent expenses claims and huge bonuses paid to bankers.

Morale in London's police force has been dented by the loss of its leader and other senior figures in recent weeks in the fallout from the phone-hacking and bribery allegations at Rupert Murdoch's British newspapers.

As courts stayed open through the night to deal with the hundreds of people charged over the violence, police flooded the streets to maintain an uneasy peace.

Steve Kavanagh, deputy assistant commissioner of the Metropolitan Police, said 16,000 officers would remain on duty in the capital on Friday. That is their biggest peacetime deployment and compares with a normal figure of around 2,500.

"London has remained calm for the last two nights and I certainly hope and pray it stays that way," he said in a statement on Thursday evening.

Occipital To Create 2nd-Generation Augmented Reality on Mobile Devices (Mashable)

Boulder-based computer vision startup Occipital has raised $7 million in Series A funding, and aims to leverage the investment to develop a next-generation computer vision platform. Occipital, a TechStars veteran, is most widely known for the hit barcode-scanning app RedLaser, which it sold to eBay last year. Now, the startup's most notable app is 360 Panorama for 3D panoramic image captures via mobile.

But Occipital has bigger plans. It wants to be the computer vision foundation -- just as RedLaser became the backbone of many barcode-scanning apps -- powering apps that will help mobile users interact with the physical world around them.

"360 Panorama is just the tip of the iceberg," says co-founder Jeff Powers. What's the whole iceberg actually look like?

"The iceberg is what sits underneath 360 Panorama -- it's the beginnings of a sophisticated computer vision platform that aims to fundamentally transform the way we interact with environments," co-founder Vikas Reddy explains to Mashable. "Think computer vision plus augmented reality and the applications that become possible when your smartphone has a visual understanding of its surroundings."

This is where third-party developers will come into play. Occipital will be soon be launching a platform that will give enterprising developers a crack at creating new layers on top of the computer vision technology inside 360 Panorama.

"Currently, there are companies that have introduced specific mobile applications that use limited computer-vision techniques," says Occipital investor and new board member Jason Mendelson. "No one has produced a platform that allows developers to create dynamic content that automatically leverages best-in-class computer vision technology."

Occipital's $7 million Series A round was led by Foundry Group. Jason Mendelson and Brad Feld of Foundry Group, Manu Kumar of K9 Ventures and Gary Bradski of Willow Garage will join the startup's board.

It took a while for a full article of Paxton Moore?s commitment to Michigan to surface, but PhillyLacrosse.com has published one such article, so we have enough material to start putting together a commitment post.

We start with the commitment article from PhillyLacrosse.com:

Moore helped the Fords finish 23-0 and claim the Inter-Ac League and Inter-Ac Invitational championships while finishing atop every national poll in 2011. He plays club lacrosse for HEADstrong.

Moore was a Gait Fab 40 pick at the Philly Showcase in 2009 and 2010 and also was selected to play in the EPSLA Showcase in 2010 and 2011.

A member of America?s best team (per LaxPower, among others)? I think we?ll be revisiting that in a moment. As a junior, multiple sources considered him a key member?of that team coming into the season, either as a second-line LSM (behind Maryland-bound senior and all-name team member Goran Murray), or a second-ish line defenseman.

His participation in the inaugural and second-annual Philly Lacrosse Showcases didn?t garner him any special mention from ESPN Rise. As a sophomore, his Blue team tied White 6-6, and his White fell to Black 1-8 last fall.

He was listed as one of the best rising junior LSMs in the Philly Area by Random Message Boarder, so take it for what it?s worth.

Running the gamut on ?sports white people play.? He is also strong academically, with a 3.6 GPA and an interest in studying Biology. Most recently, his team won the Upper Atlantic Championship.

Other Interest

Speaking of those strong academics, his other schools of interest include Penn, Villanova, Yale, Lehigh, and Colgate, some pretty tough schools. Of course, it?s unclear from a simple profile how much that interest was reciprocated from the schools, but Villanova was #13 this season to Laxpower, Yale was LaxPower?s #15 team, Colgate was #19, Penn was #20, and Lehigh finished #32.

Teammates of Note

As implied above, the High School National Champion is loaded with talent. In Moore?s class alone, he is the eighth Ford to commit to a Division-1 program, with teammates headed to places like Georgetown and reigning champs Virginia:

Moore is the eighth Haverford School rising senior to commit to a Division I college. The others are: defensemen Connor and Warner Bailey and attackman Zach Rego (Georgetown), face-off specialist Will Gural and attackman Henry Blynn (Brown), midfielder/defenseman Will McNamara (Virginia) and midfielder Sam Rohr (Penn).

The outgoing graduating class was no slouch itself, with 12 seniors signing with Division-1 programs (you?ll note that?s more guys than there ever are on the field, meaning that even some backups earned scholarships). At Moore?s position, longpoles Alex Beatty, Vince Garman, and Goran Murray signed with Princeton, High Point, and Maryland, respectively. Princeton also picked up Midfielder Brendan McGrath, with Penn the only other D-1 program to pick up multiple 2011 players in attack Chris Hupfeldt and midfielder Joe McCallion. Midfielders Carl Walrath and Matt Walters signed with the highest-profile programs, picking Virginia and Syracuse, respectively.

The 2010 class saw only three prospects sign with Division-1 schools, and the 2009 class had five signees. It?s clear that this program pumps out plenty of talent, and landing one of their (projected) starters is certainly a recruiting win.

There aren?t any individual highlight videos that I could find available on the internet, but Lax.com has a couple highlight videos from Haverford this year. You?re looking for #18 with a longpole. 11-6 W v. Conestoga, 10-9 W v. St. Paul?s.

The Upshot

As his measurements above indicate, Paxton isn?t the biggest guy in the world, but coming from such a strong program, the lacrosse IQ and athleticism are sure to be strong aspects of his game. Being a two-year contributor for a team that won the National Championship in his junior year (and for all we know, could repeat the task in 2012) brings a certain amount of cachet.

There?s not a whole lot of information about Moore?s game available, however, so it?s tough to say how soon he?ll be able to contribute. He?s certainly a really skinny guy, so at least a year bulking up seems to be in the cards, unless he adds a bunch of weight during his senior year. After that, there are too many variables in play to make specific predictions.

One thing this commitment definitely helps with is getting a foot in the door at The Haverford School, which certainly seems to be pumping out plenty of talent under head coach John Nostrant. Michigan may be able to land more of that talent going forward, especially if they see success on the field.

Drought is damaging Texas' oyster fisheries

Tracy Woody heaved a hemp bag filled with oysters across the deck of his boat and began inspecting his catch. One shell after another was empty.

It's virtually official, Woody said: the third-worst drought in state history has killed any hope that Texas oysters would make up for the severe losses in Mississippi and Louisiana, where the shellfish suffered from last year's oil spill and this year's massive flooding.

"There's no way," said Woody, a fifth-generation oyster fisherman who says he has never seen conditions this bad.

Oysters are a $217 million industry on the Gulf Coast. Louisiana and Texas account for 70 percent of the eastern species found in the Gulf and along the East Coast. Pessimism about the harvest this season is growing, even though experts won't offer a specific projection.

This year, the drought has made the water in Texas' Galveston Bay, where most of the state's oysters are harvested, so salty that predators and disease are thriving. Conditions are so dire, the deadly "dermo" parasite has been found in two reefs where it's never been seen before.

Combined with the losses in the southeastern states, consumers may be hard-pressed to find Gulf Coast oysters this year.

"There's not going to be enough oysters, the price is going to go through the roof and the consumers are not going to pay," Woody said, as workers threw hemp sacks of oysters onto wooden pallets.

Shrimp and blue crabs may also be affected by the drought. Shrimp has the biggest share of Texas' commercial fishing business, with $236 million in revenue in 2009; oysters follow, pulling in some $28 million in 2009, an off-year because of Hurricane Ike and other factors.

Galveston Bay has not experienced such high salinity since at least the 1980s, said Lance Robinson, regional director of the coastal fisheries division of the Texas Parks and Wildlife Department. "This is unprecedented," he said.

In normal years, rain in Central and North Texas fills the rivers and streams. The fresh water flows down to the Gulf and mixes with saltwater in the bays and estuaries. This environment allows oysters to thrive and reproduce. This year, there has been less than six inches of rain on average in Texas, compared to 13 inches normally.

Some believe that only about 40 inches of rain in the Dallas area would help at this point ? and it may be too late.

"If we don't get a break in the drought, I think in Texas we will find when the season opens in November most of our bays will have nothing but dead shell," said Sammy Ray, a shellfish pathologist at Texas A&M University in Galveston.

Right now, oyster fishermen like Woody are harvesting leased reefs. The public oyster fishing season runs from November through April. At that time, Woody jumps from six active boats to 12. The 60 or so workers he has now on fishing boats, on the docks and in the shucking room, increases to about 140.

This year, however, Woody is not optimistic. He and the other fishermen have still not recovered from Hurricane Ike, the massive storm in 2008 that covered reefs in sediment and buried oysters in mud.

Then, the price of oysters rose to $12 a pound. Woody kept his prices at $9 and sold only to his best customers. Woody has already used up his surplus supply of oysters. He has barely planted new shell and rock on his reefs this year because of the high salinity.

"If it keeps on this path our business is not going to grow and we're going to have to cut back," Woody said.
