Fresh Calls to Congress to Make Movie and Music Streaming a Felony

Last time there was an attempt to turn streaming copyrighted content into a felony the effort was crushed when the Internet rose up and defeated SOPA. But this week the thorny issue was again raised before Congress, with a suggestion that until the offense is considered a felony rather than a misdemeanor, enforcement will be problematic. Across the Atlantic, Pirate Bay nemesis Rights Alliance says that while enforcement against torrents continues, visitors to streaming sites are on the increase.

streamingFor close on ten years the mainstream movie and TV studios have struggled with BitTorrent piracy.

Despite years of high-profile crackdowns on sites and their users, very few inroads have been made into reducing the amount of content being shared via the famous protocol. In fact, one might argue that in the past few years things have only become worse.

Among the technologically literate youth, mechanisms for obtaining unauthorized media are now common knowledge and BitTorrent is on the way to becoming a household name.

With this in mind the studios and their music industry counterparts are now embarking on a new educational drive. Wrapped up in projects such as ?six strikes? in the United States, these initiatives aim to inform people that obtaining copyright material online without permission is illegal.

But education cuts both ways, and increasingly people are learning that it is the sharing or ?uploading? of content that is what puts people in trouble. Uploading is built into BitTorrent so aside from a user employing IP masking techniques, little can be done about that. However, there are other ways of viewing movies and TV shows online, methods that are virtually 100% safe.

These days the ?YouTube experience? is something familiar to most Internet users. Do a search, call up a page, press play and a video appears in the browser. But while YouTube specializes in general content there are dozens of sites that offer all the latest TV shows and movies in the same format and just as easily.

Fire up a site like Movie2K or TubePlus and not only are the perceived complexities of BitTorrent instantly removed, but also pretty much all of the risk too. No wonder they?re becoming so popular.

Movie2K

However, the rise of streaming sites isn?t going unnoticed. The industry-backed SOPA legislation would have allowed for harsh criminal penalties to be attached to streaming, had it not been defeated by a massive Internet revolt of course. But months on and the issue is now being raised again, on both sides of the Atlantic and beyond.

According to U.S. Register of Copyrights Maria Pallante, the legislative gap between downloading and streaming needs to be addressed.

?There is a gap in the law,? Pallante told a hearing of the House Judiciary Committee?s subcommittee on Courts, Intellectual Property and the Internet yesterday.

?Law enforcement can go after the reproduction or the distribution [of copyright material], and they can go after them in a meaningful way because they are felonies, not misdemeanors. Streaming, whether it?s a football game or music, is a misdemeanor,? she said.

pallante? If there is illegal streaming happening, especially in an egregious, willful, profit-driven kind of way, how do you get at that activity if the best that you can do is go after them for a misdemeanor?? Pallante added.

Although there is indeed a theoretical weakness in the law, one could be forgiven for thinking that wasn?t the case. The operators of streaming video portal NinjaVideo were all severely punished for their role in the site. Megavideo, a streaming service that needs no introduction, is currently the subject of the biggest copyright battle of all time.

On the flipside, other streaming and linking cases have been dealt with relatively amicably recently, including the conclusion of the U.S. case against UK resident Richard O?Dwyer and the amnesty given to operator of ChannelSurfing.

Of course the problem isn?t isolated in the United States. Over in Sweden, the spiritual home of The Pirate Bay, an interesting trend is developing.

Previously known as Antipiratbyran, R?ttighetsalliansen (Rights Alliance) is well know for its anti-piracy activities. Just recently it scooped dozens of headlines with its demand that The Pirate Bay must get out of Sweden, but largely out of the public eye it also takes action against smaller sites.

But with their successes comes a flipside ? as they continue to target file-sharing services, there is an increase in visitors to streaming sites.

?We can see that about 60 million movies were downloaded last year,? Henrik Pont?n of Rights Alliance told SVT. ?The latest figure we have on streaming is almost a year old, but then it was 20 million movies. It has increased since and we will soon get new statistics.?

Chasing down BitTorrent users in Sweden has its problems but the law is able to deal with those uploading copyrighted material, even if the punishments aren?t particularly harsh for an isolated user. However, those who watch streaming movies can do so with impunity. Not only can they not be monitored by anti-piracy outfits, but it?s possible that they aren?t even breaking the law either.

?Streaming is a growing problem,? says Pont?n. ?From the creators? point of view, it?s irrelevant what technology is used, they lose sales and legislators have to deal with that.?

In any event, it seems that streaming is here to stay. Most of the sites providing the streams are outside the U.S. and Sweden and although they don?t say much in public, their operators don?t seem overly concerned about what the authorities think. Expect the activity to continue growing as more and more ?strikes? warnings go out.

Peru surprises with 2 new amazing species of woodlizards

Thursday, March 21, 2013

Two new woodlizard species have been uncovered from poorly explored areas of the Peruvian jungles. The males have beautiful body colouration with a distinctive green pattern before a dark brown and black background. It is assumed that the two species share the same territory, with only a slight difference in altitude ranges, which makes their biological divergence intriguing from an evolutionary point of view. The study was published in the open access journal Zookeys.

Being traditionally regarded as a group with a low species diversity, recent fieldwork on Enyalioides has increased the species richness considerably with three of the ten known species described in last 5 years. The new members of this still poorly known group of animals have been discovered during expeditions on both sides of the Andes' slopes, parts of Ecuador and Peru. This success rate suggests that more of these lizards might be awaiting discovery in other unexplored areas of the region.

The two newly described lizards were found in Cordillera Azul National Park, the 3rd biggest national park in Peru protecting the largest mountain rainforest in the country. The area includes some of the least explored forests in Peru. The basins of the rivers Pisqui and Pauya in the National park are remarkable with their great diversity of reptiles and amphibians.

One of the new species, Enyalioides azulae, is known only from a single locality in the mountain rainforest of the R?o Huallaga basin in northeastern Peru. It was named after the Spanish word "azul" (blue) referring to the Cordillera Azul National Park where this species was discovered. The second newly described lizard, Enyalioides binzayedi, can be seen in the same river basin and is named after the sponsor of the field survey Sheikh Mohamed bin Zayed Al Nahyan, Crown Prince of Abu Dhabi and Deputy Supreme Commander of the UAE, who created the Mohamed bin Zayed Species Conservation Fund (MBZSCF).

"Thanks to these discoveries, Peru becomes the country holding the greatest diversity of woodlizards. Cordillera Azul National Park is a genuine treasure for Peru and it must be treated as a precious future source of biodiversity exploration and preservation!", says the lead author Dr Pablo Venegas from Centro de ornitolog?a y Biodiversidad (CORBIDI) in Lima, Per?.

GOES satellite sees Earth at equinox

NOAA

The GOES-13 satellite captured this full-disk image of our planet at 7:45 a.m. ET on March 20, just after the 7:02 a.m. ET equinox. The satellite image shows how Earth's two hemispheres receive equal amounts of sunlight during the equinox. In this image, the sun is artificially created to enhance the picture.

By Alan Boyle, Science Editor, NBC News

Earth's 23.5-degree tilt almost always ensures that the northern and the southern halves of our planet get unequal amounts of solar energy, with longer nights in winter and bigger stretches of sunlight in summer. Twice a year, however, both hemispheres get equal amounts of light, with equal intervals of day and night. That's what's known as the equinox.

Just such an event at 7:02 a.m. ET on Wednesday heralded the official beginning of spring in the Northern Hemisphere, and the start of autumn in the South. This full-disk picture from the GOES-13 weather satellite, captured at 7:45 a.m., shows the equal division between Earth's night and day.

"The visible imagery sensor on GOES requires sunlight to 'see' clouds, and so it provides a useful example of the equinox," the National Oceanic and Atmospheric Administration's Environmental Visualization Laboratory says in Wednesday's advisory. "In this image the GOES imagery extends to each of the poles since the entire hemisphere is equally lit. After the equinox passes today, the Northern Hemisphere will be more lit than the Southern Hemisphere ? causing the seasons."

Orbital mechanics may determine the precise moment of the equinox, but scientists say that the effects of the seasonal change can vary widely, due to climatic factors. There's some evidence, for example, that climate change is causing flowers to bloom earlier in the eastern U.S. than they did in the 1850s or the 1930s. Have you noticed changes on shorter time scales? Feel free to spring into action with your comments below.

Samsung's Android phones affected by another lockscreen bypass, fix is in the works

Since lockscreen bypass methods are apparently what's hot in the streets, it's no surprise that yet another one has surfaced, this time targeting Samsung's Android phones. A variant of another, earlier uncovered method, this one does not fully unlock the phone by itself, but does provide access to apps and settings for a brief period. Given that, as demonstrated in the video by Terence Eden, it's possible to use Google Play to download an app to disable the locked screen and fully access the phone.

According to Terence, this problem is confirmed on the Galaxy Note II, possibly the Galaxy S III and potentially on other TouchWiz UI Samsung Android phones. Disabling screen animations under developer options should reduce the vulnerability, but doesn't eliminate it without switching to another ROM. He also mentions Samsung is aware of the issue and is working on a fix, but that leaves phones accessible right now. We've certainly seen enough of these recently (Apple's latest version of iOS has also been victimized again in the last day) to know leaving our phones out, locked or unlocked, is foolish. At the same time, if a manufacturer insists on adding customized software to the existing platform, it could at least have the courtesy to do so without causing security leaks -- check after the break for a "bonus" vid sent in by another tipster that shows a way to activate voice commands on a locked Galaxy S II.
