Brand Protection on the Internet : Marquette University Law School ...

Professor Boyden?s Internet Law class and a legal internship, where many of my responsibilities dealt with online trademark protection of my employer?s brand name, opened my eyes to the complicated nature of brand protection on the internet.

As the internet, and internet crime, develops, trademark owners must confront the abuse of their marks as domain names in two particular ways. First, cybersquatting is registration of a domain name that contains a trademarked term with the intention of selling the domain name to the owner of the trademark at a bloated price. 15 U.S.C. ? 1125(d) (2006). Second, typosquatting is the registration of a domain name that includes an intentionally misspelled famous trademark. Typosquatting creates revenue for the squatter by capitalizing on the recognition of the mark through the placement of advertisements on the page, so that a fraction of a cent is generated by each page view from visitors attempting to reach the mark?s owner?s legitimate page. Shields v. Zuccarini, 254 F.3d 476, 483 (3d Cir. 2001).

Over the past year, a debate progressed regarding whether a third domain-name-centered manner of trademark infringement is possible. In January 2012, the Internet Corporation for Assigned Names and Numbers (?ICANN?), the corporate entity that governs domain name registration and usage around the world, opened applications for new ?generic Top Level Domain Names? (?gTLDs?), creating an essentially unlimited number of domain names that may be registered in the future. Instead of the standard Top Level Domain Names like ?.com,? ?.org,? ?.gov,? ?.net,? or country-coded domain names (for example, the United Kingdom?s ?.co.uk,? Canada?s ?.ca,? or New Zealand?s ?.nz?), ICANN opened possible domain name endings to include any word that a party is interested in registering. ICANN received 1900 applications for new domain name endings before the application window closed on May 30, 2012.

Applicants are vying for the right to administer the secondary domain names that come after the ?www.? and before the ?.whatever? in a domain name. Certain gTLDs resulted in bids from multiple applicants. These generally include common words and phrases like ?.tech,? ?.beauty,? ?.blog,? ?.coupon,? ?.hotel,? ?.inc,? ?.mail,? ?.news,? ?.sucks,? ?.restaurant,? and ?.vip.? Because a $185,000 fee must accompany each application, registration applications for gTLDs that incorporate brand names were almost always restricted to parties with a claim to the brand. Examples of these applications include ?.hermes,? ?.kindle,? ?.lamborghini,? ?.lexus,? ?.microsoft,? ?.oldnavy,? ?.qvc,? ?.scjohnson,? and ?.swatch.? Now that the list of potential registrations is online, a seven-month period for objections and comments is open. ICANN hopes to elicit challenges by parties that did or did not submit an application about potential damages inflicted if a bid for a specific gTLD is accepted. Most potential complaints and objections will likely be based on intellectual property grounds.

Potential challenges to applications include several scenarios. First, it is possible that a trademark owner did not apply for a gTLD based on the mark he owns, but that someone else did apply for a related gTLD. The solution is simple: when ICANN?s gTLD process concludes, mark owners will have the first opportunity to register secondary domain names associated with the gTLDs. For example, hypothetically, if Hilton is awarded the ?.hotel? gTLD, Ramada, Holiday Inn, and other hotel chains would likely have priority in establishing ramada.hotel, holidayinn.hotel, and so on).

The most severe concern from internet law scholars and observers when the gTLD process was announced was that typosquatting and cybersquatting would be extended to the gTLDs. Because the cost of applying for a gTLD was so high, however, only those with legitimate claims to the names seem to have applied to secure a gTLD. Yet, a second challenge may emerge after the initial gTLDs have been awarded: cybersquatting on the secondary domain names. For example, it would be easy for a squatter to register a misspelled trademark on a variety of different gTLDs, even if the gTLDs have nothing to do with the trademark. Further, this type of squatting would be very difficult for trademark owners to police. It is likely, though, that if these instances of advanced squatting are found, an appropriate resolution can be achieved through the current Uniform Domain Name Dispute Resolution Policy, an arbitration-based ICANN initiative that has generally proven to be successful in awarding squatted domain names to trademarks? owners.

A third scenario may invoke a challenge to an application when more than one applicant applied for the same gTLD, and more than one of those applicants have legitimate claims to the mark. An often-cited example of this type of challenge is ?.delta.? Delta Airlines submitted an application, and if Delta Faucets had also submitted an application, one of the companies would need to show that the acceptance of the other?s gTLD application would harm its brand.

If a party did not contemplate potential intellectual property effects of this new gTLD system before the application window closed, the crucial time to protect trademarks is right now, during the comment period. However, it is unclear how ICANN will determine claims of harm to particular brands, or how it will navigate a dispute between two distinct parties who both have a legitimate claim to the same gTLD.

Ultimately, new gTLDs will be posted in March 2013 in groups of 500, according to ICANN.

4. Adjust the brightness and color temperature on your computer settings. Adjust the brightness of the display so it?s approximately the same as the brightness of your surrounding workstation. Color temperature describes the spectrum of visible light emitted by a color display. Reducing the color temperature of your display lowers the amount of blue light emitted by a color display for better long-term viewing comfort.

Bahrain police disperse Shiite protests

Bahraini security forces fired birdshot and tear gas to disperse protesters in Shiite villages around the capital, witnesses said on Tuesday, as police announced the arrest of 11 "saboteurs".

Several protesters were wounded as police dispersed demonstrations overnight that were called by the "Youth Coalition of February 14" to mark the Sunni-ruled, Shiite-majority Gulf state's independence, witnesses said.

The number of casualties was difficult to assess, as protesters stay away from hospitals for fear of being arrested.

The interior ministry said: "Several areas of Bahrain witnessed riots and vandalism and attempts to block vital roads."

An "illegal demonstration" took place in the village of Bani Jamra where protesters hurled "petrol bombs and metal rods," it added.

"Security forces managed to arrest 11 saboteurs, who are currently being referred to the public prosecution."

The ministry also said that a group of "saboteurs" used petrol bombs to attack a car being driven by a woman, at the entrance to the Shiite village of Abu Saybi.

Sporadic demonstrations in Shiite villages have intensified since last year's crackdown, which ended month-long protests dominated by Shiites in the capital Manama.

Bahrain won independence from Britain on August 15, 1971.

But the kingdom, which is ruled by the Sunni Al-Khalifa dynasty does not celebrate independence. Instead, it observes the coronation of former ruler Isa bin Salman Al-Khalifa as National Day.

Meanwhile, Bahrain's public prosecution said the number of people detained over protests since Februrary 2011 had reached 923, contesting a claim by the Shiite opposition that 4,500 people were arrested.

Baby Food: Essentiels to Make Your Own Baby Purees | At Home ...

Introducing a baby to solids can be challenging for new moms. After trying several brands of store-bought vegetable purees, it became clear that if I wanted my son to develop appetite and to stimulate his taste buds, I must cook my own vegetable purees. It is fun and if you do in batch, it will not require a lot of your time.

Before I gave birth, I wanted one of these fancy baby food machines. Let me tell you that you don?t need one. I bought a Beaba Babycook, read the manual and return it. My method is simpler, uses what you already have in your kitchen and would not become useless 6 or 7 months later.?Talking to a few moms convinced me that a baby food machine didn?t worth the trouble, the cash and the extra counter space. Instead, I upgraded my 20-year old immersion blender for a sturdy model with a chopper attachment with lid. I never looked back.

Batch Cooking and Freezing

If I was making mashed potato and carrot for our dinner, I doubled the recipe. I froze the rest in ice cube trays. I use standard ice cubes (because I had them), the trays from KidCo and the PLASTIS ice cube trays from IKEA. If you need to equip yourself, buy two standard size silicone trays ? it is easier to remove the food from them???and a few PLASTIS trays. The smaller size of the PLASTIS trays is practical for adjusting how much food you serve to your baby.

Season the Baby Food

My goal was that Zack could easily transition to what we eat for dinner.?I developed recipes that fit my cooking style. For me, that means seasoning the food. Right from the start, I use butter, olive oil, onions, freshly ground pepper, ginger, fennel, and herbs to provide an array of flavour to my baby.

The Basis of my Recipes

I boiled the ?vegetables in a marguerite. I tried roasting in the stove one or twice without success. I cut the vegetables in small pieces to reduce the boiling time. Each puree includes two or three vegetables that complement each other in taste and texture. I cooked them together.

I experimented a lot. Don?t hesitate to look at what inside your fridge or on your counter before you start. One of my yummiest recipe was a batch of caramelized onions that I mixed with boiled carrots. For inspirations, I looked at soup recipes. The list of ingredients triggered delightful mixes that became my signature purees.

Zack adored these recipes:

  • Ginger flavoured sweet potato and zucchini puree. I added a small potato to absorb the water of the zucchini.
  • Ginger flavoured carrot and red onion puree.
  • Mashed cauliflower and potatoes with a touch of fennel.

Have you cook any tasty purees lately? What is your secret?

Zack now eats like us. No more purees for him; in his mind, he is a big boy. He looks forward to lunch and dinner. He eats by himself and likes everything, except for eggs that he never cared for. We will never know if making his purees played a role in that but I am sure that it didn?t hurt. I encourage any mother to make their own baby purees. All you need is your pots and pans, a handblender, good ingredients and a little bit of imagination.

Paul Ryan's wife no stranger to Washington power circles

WASHINGTON (Reuters) - Janna Ryan, thrust onto the national stage this weekend when her congressman husband Paul Ryan was named the Republican vice presidential nominee, strikes an appealing image as a stay-at-home mom raising three young children in Wisconsin.

But the 43-year-old has been a Washington operative herself, hailing from a well-connected family and forging an early professional career as a congressional aide and healthcare lobbyist.

Friends describe her as being able to navigate between different worlds -- from small-town Oklahoma and Wellesley College, a private women's college outside Boston that she attended, to complex policy debates in Washington.

"She is very comfortable in and around politics. She grew up in a political family, and it comes very naturally to her," said Leslie Belcher, a Washington lobbyist who worked on Capitol Hill with Ryan and was later one of Ryan's bridesmaids.

During her first public test, Ryan appeared at ease on Saturday as Republican presidential candidate Mitt Romney introduced her husband at a tightly orchestrated event in Norfolk, Virginia, with the retired battleship USS Wisconsin as the backdrop. She beamed alongside Mitt Romney's wife, Ann Romney, both polished with blonde hair.

Ryan, whose last name was Little before her marriage, grew up in Madill, in southern Oklahoma. Both of her parents spent their careers as lawyers in private practice. Her mother graduated first in her class at the University of Oklahoma law school. A town in Oklahoma, Little City, is named after the family, dating back several generations.

Her family has strong Democratic connections, and largely identify with the Blue Dog Coalition, a group of Democratic lawmakers known for being fiscally conservative.

Her uncle, David Boren, served as a Democratic governor of Oklahoma and later as senator from the state. Boren's son, Dan Boren, is a member of House of Representatives and as a Blue Dog Democrat, has often voted with Republicans.

After college she worked as a legislative aide to former Oklahoma congressman Bill Brewster, who was a co-founder of the Blue Dog Coalition.

While in that job she worked on transportation and healthcare issues and attended George Washington Law School at night, earning her degree in 1998.

Ryan parlayed her law degree and Hill experience into a lobbyist job, working for several years at Williams & Jensen and at PricewaterhouseCoopers.

Her roster of clients included pharmaceutical and insurance clients such as Novartis, Cigna and Blue Cross/Blue Shield, according to lobbying records.

She married Paul Ryan in 2000 after the two met in Washington and moved to his hometown of Janesville, Wisconsin, where she now raises their three children.

A Milwaukee Journal Sentinel article in 2000 said their upcoming nuptials would be "depriving Congress of one of its more eligible bachelors."

"They got married eyes wide open, knowing that they wanted to dedicate themselves to public service, and that meant that Janna wouldn't work, and Paul would dedicate himself" to working in Congress, said Jodi Bond, a vice president at the Chamber of Commerce who has been friends with the Ryans for decades.

While the campaign is still sorting out exactly what her role on the campaign trail might be, friends suggested she would be an asset to Romney-Ryan ticket.

"I think she is very relatable," said Missy Edwards, a lobbyist in Washington who became friends with Ryan when they both worked on Capitol Hill together in the 1990s. "She's from a small town, (with) three young kids, smart, and focused on her family, first."

Stress and Exercise Part 2 of 3: Why is Post-Workout Recovery So ...

Ensuring adequate recovery after exercise will help you reach both your health and performance goals.

Performance training is not just about physical ability, but it?s having mental patience and intuitive self-awareness as to the unique limitations of your body and getting to that final race-day in the first place.

To win the race, you have to first be in the race!

So how do we get ourselves there?

Athletes and weekend warriors alike need to acquire that sense of knowing when to push and when to pull back. I hear too many stories of marathoners and triathletes alike succumbing to fatigue or injury just a few weeks or even days from their target competition date.

Not only do athletes like Michael Phelps have extraordinary nutrition plans and training schedules, they also have equally extraordinary recovery procedures ? replete with ice baths and appointments with trainers, chiropractors, doctors, nutritionists, massage therapists and more?

If you want elite Michael Phelps-like performance, you need an elite Michael Phelps-like team to help get you there. It?s their full-time job to train and recover and I ask my patients to keep their own performance aspirations in perspective.

I also know that many of us do not aspire to be Michael Phelps, so with just some ice, a foam roller, and some general nutrition & training advice, you already have 80% of the tools you need to accomplish your goals.

A Note on Passion

Most of us reading this newsletter may just be weekend warriors with a deep passion for fitness and life.

Passion fuels the rush of adrenaline and the release of feel-good endorphins. Passion is what gives us that deep sense of satisfaction we feel at the completion of a race.

Passion, however, does not mix well with nagging injuries and persistent performance plateaus.

I suggest engaging in deep introspection as to where you are at and what it?s going to take to get you to where you want to be six months from now. At this point you may have to start thinking about next season.

High Intensity Interval Training

High intensity interval training is effective because it alternates quickly between periods of rest and activity ? increasing the body?s capacity to deal with an increasing variety of physical challenges ? such as choppy ocean water, steep road terrain, or even days when you may feel ?off? physically & emotionally.

With high-intensity exercise, not only do you become stronger, you also improve your endurance capacity.

Some ultra-long distance runners train with ladder workouts consisting of short, intense 200m-400m and 800m runs, with appropriate rest periods, and a long-run thrown in on lighter training days.

But while high intensity training can do wonders for body composition, cardiovascular health and fitness capacity, we learned in Part 1 that it can also quickly lead to adrenal fatigue, difficulty falling or staying asleep, testosterone and estrogen?imbalance, belly fat, hypothryoidism, autoimmune complications, immune suppression, depleted energy, low bone mineral density, and mood disturbances.

Why is Exercise Recovery Important?

The body prefers to obtain its fuel (sugar) first from easy-to-access stores in your liver and muscle in the form of glycogen.

When working at 90-95% intensity, it?s easy to quickly blow through these glycogen stores. Soon your body starts pumping out stress hormones such as cortisol, norepinephrine, and epinephrine, to increase blood flow to muscles in your arms and legs & initiate gluconeogenesis?- a process of making sugar to provide necessary fuel for your cells.

In short, stress hormones allow you to reach new levels of performance and assist short-term performance gains. Without replenishing your glycogen stores immediately following a workout and giving time for your stress hormones to balance out, your body may:

  1. Be only 80-90% recovered before your next training session, causing you to work out even more intensely, and still see your performance flat-line.
  2. Start eating lean muscle tissue as though it were candy, decreasing your ability to burn fat (especially belly fat).

Is international justice finally finding its footing?

A prison sentence for a Congolese warlord. A court ruling for a Chadian dictator to be tried for torture. Some 67 years after Nuremberg trials, international courts and tribunals are making their mark.

A glowering Thomas Lubanga Dyilo entered the pages of history in early July when he became the first person to be sentenced to prison by the International Criminal Court in The Hague. The Congolese warlord?s earlier conviction by the ICC was the first time in legal history that recruiting children into armed conflict was found to be a war crime. Score one for universal justice transcending borders and for expanding definitions of war crimes.

Meanwhile, the International Court of Justice ? an institution separate from the ICC ? on July 20 ordered that a 1984 treaty obligated Senegal to either prosecute former Chad dictator?Hiss?ne Habr? for torture, murder, and other charges or extradite him to another country. Score one for the respect of state sovereignty, of treaty law and of universal human rights.?And just Tuesday, the ICC for the first time ordered that the victims of Mr. Lubanga's crimes were entitled to reparations: monetary payments for their suffering.

So where are we on the long arc of the moral universe? Sixty-seven years after Nuremberg has it finally, conclusively, bent toward justice? Have the Auschwitzes, Khmer Rouges, Srebrenicas, and Rwandas finally been remanded to a dusty back shelf in a library?

The ICC?s first sentence coincided with its anniversary. The court opened its doors 10 years ago last month, empowered by treaty to prosecute genocide, crimes against humanity, war crimes, and eventually crimes of aggression. It was a great leap forward for the notion of universal justice: that some crimes are so heinous that their outrageousness transcends borders, language and culture. It?s the idea that some crimes are so unspeakably evil that their punishment must shatter the three-century-old bedrock of international relations: that only a nation has supreme authority over the crimes of its citizens.

This is what the nations that negotiated the Rome Treaty establishing the ICC agreed to. Today, 121 of the world?s 194 countries are signatories. ?

What is more noteworthy is what the court has not done and what it cannot do. And may never do.

The ICC as a creature

For all its noble intentions, the ICC is a political creature, the Rome Treaty is the product of intense negotiation and compromise. First and foremost, the court and its legacy are closely tied to the politics of the preeminent organization charged with safeguarding international peace and security: the United Nations Security Council.

Billionaire George Soros getting married for the third time

(Reuters) - Billionaire investor George Soros had a lot to celebrate on Saturday evening: his 82nd birthday and the engagement to his much younger girlfriend, Tamiko Bolton.

Soros and Bolton, who met in the spring of 2008, formally announced their engagement at a party at Soros' summer home in Southampton, New York, attended by a small group of friends and relatives, according to a person familiar with the investor.

Soros proposed to Bolton, 40, a few weeks ago during a weekend visit to the Hamptons, a beachside colony on Long Island frequented by New York's wealthy.

For Soros, this will be his third marriage and the second for Bolton, who was married briefly in the 1990s. Soros has five children from his previous marriages.

Last year, Adriana Ferreyr, a former girlfriend of Soros, filed a lawsuit alleging he had reneged on a promise to buy her an apartment. Soros has filed a pending motion to dismiss the suit by the former Brazilian soap opera star.

Ferreyr's attorney, Robert Hantman, said: "I wish him the best of luck on his marriage, and now that he doesn't need the apartment, hopefully the case can be resolved."

Soros, who is an active contributor to politically liberal causes and frequently speaks on world economic events, converted his hedge fund into a family office in 2011 and stopped managing money for outside investors.

Soros rose to fame and fortune two decades ago on a now-historic trade, in which he took on the Bank of England and shrewdly wagered on a devaluation of the British pound.

Bolton, who once started an Internet-based dietary supplement business and is now running a web-based yoga education business, has a master's degree in business from the University of Miami.

The engagement ring Soros gave Bolton, according to a person close to him, is a Graff diamond in a platinum setting on a rose gold band.

Among the guests at the party at Soros' summer home were journalist Jane Bryant Quinn and Blackstone's Byron Wien.

Earlier this year, Reuters first reported that Soros' son, Jonathan, who last September stepped down from day-to-day management of the affairs at Soros Fund Management, had decided to set up his own family office. In moving to manage his own money, Soros' son also planned to take on key employees of Soros Fund Management, which last reported having about $25 billion in assets.

Most (and least) livable states of the future

Salt Lake City is the capital of Utah, which could be the most livable state of the future.

Media reports regularly rank the country?s states in terms of their current economic situation, health, jobs and even water quality. But what about their future? That?s what Gallup?attempted to find out.?The national polling agency recently released a report identifying the ?future livability? of every state in the country, or the best and worst states to live in the future.

24/7 Wall St.: America's most (and least) peaceful states

Based on surveys conducted over 18 months that measured current sentiment, Gallup identified 13 metrics that can be used to gauge how livable states will be in the future. Some questions, which measure each state?s economy, job prospects and personal finances, are designed?to predict the future economic prospects of a state. Others measure current quality-of-life components that can have an effect on long-term health. These?include rates of obesity, smoking and the availability of safe, clean water.

24/7 Wall St. spoke to Dan Witters, research director of Gallup-Healthways Well-Being Index, about how Gallup chose the components that made up its future livability score. According to Witters, each metric ?gives some sense of how livable that area, that state, that community is going to be down the road.?

Responses that reflect current conditions, Witters explained, can also be used to measure the future livability and prosperity of a region. ?If you have high economic confidence and strong job creation and high full employment, does that guarantee that you will [have the same] 20 years from now? No, obviously not,? he said. But what these factors do,?Witters said, is increase the probability that a region will have?improved economic vitality down the road.

The health factors Gallup considered ? obesity, smoking and dentist visits ? are similarly predictive of long-term health. Obesity, for example, is one of the best predictors of diabetes. According to Witters, in states with high obesity, including West Virginia, Mississippi and Kentucky, ?the probability that you?re going to have high levels of high blood pressure, high levels of cholesterol, high levels of physical pain? is higher.

In addition to the 13 metrics considered by Gallup, 24/7 Wall St. reviewed additional measures of economic and social well-being. While the states that score well or poorly for future livability appear to have little in common geographically, they have other factors in common.

Unemployment rates, for example, appear to?have a strong relationship to the overall future livability rank. Eight of the 10 states with the best future livability scores have among the 15 lowest unemployment rates as of June. Included are?North Dakota and Nebraska, which have the lowest and second-lowest rates.

The wealth of a state?s population also appears to be an indicator of the future livability of a state. Eight of the 10 states with the worst future livability scores are in the bottom third for median income. This includes Arkansas, West Virginia and Mississippi, which have the three lowest median household income figures as of 2010, the most recent available data.

24/7 Wall St. reviewed the 13 measures Gallup included in its future livability report, all of which are for the most recent 18 months. At Gallup?s direction, we?checked earlier versions of some of these surveys in order to provide figures where current data is unavailable. We also considered poverty, income, food stamp recipient rates?and health insurance coverage from the U.S. Census Bureau for 2010, the most recent available year. We also reviewed June 2011 and June 2012 unemployment figures from the U.S. Bureau of Labor Statistics, as well as home price projections from Q1 2012 from Fiserv.

America's most livable states

1. Utah

  • ?Future livability score:?7.5
  • ?Full-time employment:?21st best
  • ?Job creation index:?fifth best
  • ?Outlook on life in five years:?21st worst

Job creation has been booming in Utah. The state ranks sixth highest in Gallup?s job creation index and has the 10th-lowest unemployment rate of any state in the country as of June. In 2011, the proportion of respondents stating that their employers were hiring was 20 percentage points higher than the proportion stating their employers were letting people go. Positive attitudes go well beyond just the number of jobs. In the past 18 months, residents of Utah were more likely than those of any other state to claim they felt treated like a partner at work and to claim they had easy access to clean water. People in Utah not only like where they live, but they are also very healthy. No state has fewer smokers and just four states have lower obesity rates.

2. Minnesota

  • ?Future livability score:?10.5
  • ?Full-time employment: eighth best
  • ?Job creation index:?10th best
  • ?Outlook on life in five years: third worst

The Gopher State ranks first in economic confidence and the ease of finding a safe place to exercise. The Land of 10,000 Lakes also comes in second for the ease in finding clean, safe drinking water. With the seventh-lowest rate of smoking, the fifth-highest rate of regular visits to the dentist and the proportion of the population insured, Minnesotans are a healthy bunch compared to their fellow Americans. Despite all of this, the state is projected to have the fourth-worst change in home prices between the first quarter of 2012 and the first quarter of 2013, with an almost 5 percent drop compared to a national average projected decrease of 1 percent.

3. Colorado

  • ?Job creation index:?18th worst
  • ?Outlook on life in five years:?18th worst

Colorado residents are among the healthiest in the United States. With an obesity rate of 18.5 percent,?Colorado is the only state to have an obesity rate below 20 percent as of 2011. The state also ranks third in terms of finding a safe place to exercise. Colorado?s 20 percent smoking rate, while not as impressive as its low obesity rate, is below the national average of 21 percent. The state?s unemployment rate is the same as the national average at 8.2 percent. But of all states, Colorado has the fifth-lowest decline in unemployment from 2011 to 2012, dropping only 0.2 percentage points compared to 0.9 percentage points in the U.S. as a whole. However, for those who have jobs, the state ranks third in managers who treat their employees like partners.

America?s least livable states

1. West Virginia

While West Virginia has an unemployment rate of 7 percent, well below the 8.2 percent national unemployment rate, it ranks second-worst in terms of people employed full-time. The state also has the second-lowest median household income of $38,218 and the eighth-highest percentage of people below the poverty line, at 17.62 percent. West Virginia also can lay claim to the dubious title of unhealthiest state. It has the highest rate of smokers in the nation with a quarter of residents smoking as of 2011. The state also has the highest obesity rate (35.3 percent), the highest rate of people with high blood pressure (38.9 percent) and the highest rate of people with diabetes (15.7 percent) as of 2011. Options for those looking to stay in shape are limited as the state ranks dead last in ease of finding a safe place to exercise.

2. Mississippi

While Gallup ranks Mississippi second worst for future livability, residents feel good about their own future as the state ranks first for the best outlook on life in five years? time. But the Magnolia State has the lowest percentage of people employed full-time and the lowest median income in the country at $36,851, less than three-quarters of the national average of $50,046. Mississippi ranks worst in the country in the percentage of the population living below the poverty line and in the percentage of residents who feel?that their manager treats them like a partner and not like a boss. Mississippi is also among the worst in several important areas of health. The state has the second-highest rate of obesity and the fifth-highest percentage of smokers. It is also ranks second worst in finding a safe place to exercise and has the lowest percentage of residents who have visited the dentist in the last year.

3. Kentucky

  • ?Full-time employment:?16th worst
  • ?Job creation index:?23rd best
  • ?Outlook on life in five years:?20th worst

Kentucky?s median household income of $40,062 is the fourth lowest of all states and about $10,000 less than the median income across the U.S. The state also has the fourth-highest percentage of people below the poverty line and people on food stamps/SNAP benefits. It is not surprising that the state has the eighth-lowest score on the economic confidence index. Kentuckians' health is also poor. The state has the second-highest rate of smokers, with an estimated 29 percent reporting smoking in 2011, the seventh-highest obesity rate and the 10th lowest rate of people who say they have visited the dentist in the past year. Kentucky ranks fourth from the bottom in ease of finding a safe place to exercise.

Romney names Paul Ryan his No. 2

NORFOLK, Va. (AP) ? Republican presidential candidate Mitt Romney tapped Rep. Paul Ryan of Wisconsin as his vice presidential running mate for the fall campaign on Saturday, turning to the architect of a conservative and intensely controversial long-term budget plan to remake Medicare and cut trillions in federal spending.

Romney made his announcement to supporters via a phone app.

"Mitt's Choice for VP is Paul Ryan," it said and implored backers to spread the word.

The ticket-mates arranged their first joint appearance later in the morning at a naval museum, first stop of a bus tour through four battleground states in as many days.

In a statement issued Friday night, Romney's campaign said only that the running mate would be present at 9 a.m. EDT at the Nauticus Museum. The USS Wisconsin is berthed there ? offering a hint about Ryan's selection.

Ryan's selection ? as well as Romney's own nomination ? will be ratified by delegates to the Republican National Convention that begins on Aug. 27 in Tampa, Fla.

President Barack Obama and Vice President Joseph Biden will be nominated for a second term at the Democratic convention the following week.

At 42, Ryan is a generation younger than the 65-year-old Romney.

His conservative credentials are highly regarded by fellow Republican House members, while numerous polls found that Romney's own were suspect among the party's core supporters during the primaries of winter and spring.

A seventh-term congressman, Ryan is chairman of the House Budget Committee, and primary author of conservative tax and spending blueprints that the tea party-infused Republican majority approved over vociferous Democratic opposition in 2011 and again in 2012.

It envisions transforming Medicare into a program in which future seniors would receive government checks that they could use to purchase health insurance. Under the current program, the government directly pays doctors, hospitals and other health care providers.

Ryan and other supporters say the change is needed to prevent the program from financial calamity. Critics argue it would impose ever-increasing costs on seniors.

Other elements of the budget plan would cut projected spending for Medicaid, which provides health care for the poor, as well as food stamps, student loans and other social programs that Obama and Democrats have pledged to defend.

In all, it projected spending cuts of $5.3 trillion over a decade, and cut future projected deficits substantially.

It also envisions a far reaching overhaul of the tax code of the sort Romney has promised.

In turning to Ryan, Romney bypassed other potential running mates without the Wisconsin lawmaker's following among rank-and-file conservatives, including Ohio Sen. Rob Portman and former Minnesota Gov. Tim Pawlenty.

Republican officials said Romney had spoken with both men.

Romney and Ryan appeared unusually comfortable with each other when they campaigned together earlier in the year. The former governor eagerly shared the microphone with the younger man and they shared hamburgers at a fast food restaurant.

In making an endorsement before his state's primary last spring, Ryan said, "I picked who I think is going to be the next president of the United States ? I picked Mitt Romney. ... The moment is here. The country can be saved. It is not too late to get America back on the right track. ... It is not too late to save the American idea."

Romney was the subject of an April Fools prank in which Ryan played a role. Romney showed up at a supposed campaign event where he heard Ryan calling him "the next president of the United States" ? only to find the room nearly empty.

In recent days, conservative pundits have been urging Romney to choose Ryan in large part because of his authorship of a House-backed budget plan that seeks to curb overall spending on benefit programs such as Medicare, Medicaid and food stamps.

Republican National Committee finance chairman Ron Weiser of Michigan, said Friday night that Ryan's selection would help Romney win Wisconsin and its 10 electoral votes in the fall. The state typically supports Democrats in presidential contests, and Obama won it handily four years ago.

Ryan has worked in Washington for much of his adult life, a contrast to Romney, who frequently emphasizes his experience in business.

The congressman worked as an aide in Congress, and also was a speechwriter for Jack Kemp, who years earlier had been one of the driving forces behind across-the-board tax cuts that were at the heart of Ronald Reagan's winning presidential campaign in 1980.

Ryan is also well-known for his fiendish physical fitness workouts.

His congressional district in southeast Wisconsin has something of a bipartisan voting record. Obama took 54 percent of the vote there in 2008, while the congressman received 64 percent in winning re-election.

Outside Ryan's home in Janesville, Wis., on Friday night, there was nothing to suggest that the residence belonged to a vice presidential candidate. An Associated Press reporter who knocked just before midnight got no answer. There was a light on in a first-floor room of the two-story brick home atop a hill.

Earlier this week, a Ryan adviser said the congressman, his wife and their three children were preparing for a weeklong Colorado vacation.

Most of Romney's staff learned of the planned announcement during a 10 p.m. EDT conference call Friday about an hour before the campaign issued a statement. The identity of Romney's pick was not disclosed during the call. The campaign had promised that first news of the selection would be delivered via a phone app.

Earlier in the day, Romney's campaign briefed reporters on the bus tour without mention of the impending vice presidential announcement.

The tour will take Romney through North Carolina, Virginia, Florida and Ohio. All are battlegrounds where Obama won in 2008. They hold 75 electoral votes combined, of the 270 needed to win the election.

Today, I'm delighted to be interviewing with Jennifer Castle, author of The Beginning of After.

Book Synopsis

Sixteen-year-old Laurel?s world changes instantly when her parents and brother are killed in a terrible car accident. Tell us a little about yourself and how you became a writer.
I've always been a writer in one way or another. I went from being the Poetry Geek in middle and high school to writing short stories in college, to setting out for Los Angeles to become a screenwriter. Even when I was working boring office jobs to pay the bills, I was always chipping away on a script in my spare time. I had an agent and went out on lots of meetings, and several of my screenplays came very close to selling, but nothing ever worked out. Walking away from that pursuit was really hard, because I felt like I was now a failure, but in retrospect I'm glad because it forced me to finally start working on a novel. I just wanted to finish it because I knew I had one in me, and I didn't want that deathbed-regret of feeling that I was so lame, I couldn't finish a book. Fortunately, that book got finished and was good enough for an agent to take on, and fortunately it was the right agent. Sometimes I feel bummed that I didn't go back to fiction much earlier, so that by now I'd have a few novel under my belt, but then again, I think "The Beginning of After" is the kind of story you have to grow into. Who knows what kind of awful crap I would have written in my 20's!

You've worked quite a bit with teen-related sites. How have your experiences with these impacted your writing?
Creating media for young people, whether it's content on a website or a book or whatever, forces you to stay tapped into that part of yourself that's forever sixteen years old. Most of my work has involved what they call "psycho-social issues" or "life skills," and I've learned a lot about the things we all struggle with emotionally when we're teens. Then, of course, you realize that you never stop struggling with many of these issues, you just get better at handling them or have new ways to deal. But they stay with you for life, and they continue to fascinate me. So I'm always interested in writing about the daily in's and out's of becoming who we really are, interacting with the people around us, discovering how we can lay down an authentic path in the world. It may not seem exciting, on the outside, as creating a dystopian future or alternate reality in fiction, but for me, the possibilities are endless.

The Beginning of After has evolved since its initial inspiration in 2001. How has Laurel and her story changed since you first came up with the idea?
Originally, I wasn't writing a Young Adult book. I was going to tell Laurel's story in three parts, spanning the years after the accident, through college, and into her early 20's. But I was really flailing and the story had no focus, except for the relationship with David whenever he dropped in. So I had an epiphany one day that Laurel's story could be told in a much shorter period of time because the most interesting part of it was the months after the accident. The story really changed from portraying Laurel's path into adulthood and a future shadowed by tragedy, into the aftermath of the accident and how Laurel's world was suddenly altered in every way. Which makes for a much better book, I think. Sometimes I feel that I prefer reading YA to "adult" fiction because everything in YA is so immediate. There's no B.S. It gets straight to the heart of things!

What did you learn while researching for The Beginning of After?
Well, the biggest and most important thing I learned is that everybody deals with grief differently. That gives you a ticket to freedom, as a writer, because I just had to focus on creating realistic characters, then be true to those characters in the way they grieve. The other big thing I learned, and continue to learn, is that people have amazing abilities when it comes to survival and hope and love. They find a way to go on after the most horrible, tragic things happen. It's incredible.

In the aftermath of Laurel's loss, people begin to treat her differently, and she falls into a depression. What difficulties did you encounter while developing her character and portraying her in a realistic and compelling manner?
In earlier drafts of the book, Laurel was pretty passive. Everything was happening "to" her. She just sucked it up way too well. Even though I wanted her to be bottling up many of her emotions in order to get through each day, and I felt this was realistic, as a writer you also have to think about what's going to annoy or frustrate the reader. So slowly, I let Laurel be angry, and selfish, and really lose it (especially when it comes to David). That ended up giving her a lot of dimension and an extra layer of realism, and I loved her so much more after she got a little more badass.

Laurel and David's relationship is complex, as they both grieve for their families, but it was David's father behind the wheel. The emotions they convey are powerful and relatable. What went into the dynamics of their relationship to help the two make a connection that is so real and there?
That's a tough question! This is going to sound really flaky but I think it was just a perk of having lived with the characters for so long and really knowing them. Whenever I put them together in a scene, they would just talk on their own and I was doing little more than taking dictation. While I was making Laurel a tougher and more assertive in later drafts, I was also making David more sympathetic. They had to match or complement each other at any given time, so going by that rhythm really helped me create the relationship.

I love animals and was drawn into Laurel's experience at the Ashland animal hospital. Did you always plan for her work with animals?
I did. When I first started thinking about this story, I was heavily involved with cat rescue in Los Angeles. I knew what working with animals did for me, and I saw what it did for many of the other volunteers who devoted time and energy -- sometimes their whole lives, it seemed -- to this passion. In some cases, I got the sense that the work with animals was compensating for a lot that was missing in someone's life. For me, personally, it gave me great rewards and fulfillment at a time when my professional life was not going so hot. So I wanted to explore that theme in a novel: the ability of animals to give you whatever it is you need, even though that's different for each person.

Could you tell us a little bit about your upcoming novel You Look Different in Real Life? How did you come up with the title?
But of course! It's about five teens who are the subjects of a documentary series that peeks in on their lives every five years. Now they're sixteen and the cameras are coming back for another film. What would you do? Would you change your life so it looked better on camera? Would you feel you were living for yourself, or for other people's expectations? And how does a documentary film affect the relationships between the people who are the subjects? Hmmm. The book is a chance for me to explore all that, and also to write in a totally different, much funnier and sarcastic voice. Nobody dies in this novel, but there's plenty of drama. The title was something my husband suggested after a very long and crazymaking struggle to find one that fit the tone of the book. "You look different in real life" is something people might say to these characters and the characters to one another, but it's also something that applies to all of us. We all live partly in the media -- on Facebook or YouTube or blogs, etc. The version of ourselves that we broadcast to the world doesn't always resemble the version we see in the mirror. Ah, this stuff is so juicy. I'm really excited about the new book and can't wait for it to come out next summer!

I?m finally about to get my career underway. I?m a pretty frugal person, so even though the initial pay isn?t fantastic I should be able to save at least $ 10,000 in the first year while I pay off all of my credit card debt and auto loan debt. From then on out it?s about 24k of structured student loans.

Each subsequent year, I should be able to save at least $ 20,000. So over the course of 5 years with a small amount of interest, I should have $ 100,000 saved. I would like to put this toward the purchase of a house. Hopefully the housing market will be stabilized and deflated by then so I can make a wise investment. (Yes, deflated.) Here?s where I?m uncertain. The dollar is volatile, to say the least. If I hold onto my assets in the form of dollars, then my $ 100,000 in 2014 could have the buying power of 50k of today?s dollars, or even 20k or worse.

Would I be wise to convert the balance of my savings account into Euros? Can I even do that in a domestic bank, or would I have to open an overseas account? I?m trying to anticipate a solid way to save my money and maintain its buying power through thick and thin. I would be stupid to put money on a house before the upcoming Option-Arm housing crisis runs its course and the market loses another $ 1-2 trillion.

I?m even contemplating buying gold (not gold ?investing? as you see on those commercials, but physically owning gold coins), but that comes with a whole other set of concerns for keeping it safe.

3. What if You Don't Have an Estate Plan?

Here is Part 3 of my series, Estate Planning ? What You Need to Know.

What if You Don?t Have an Estate Plan?

Simply put, if you don?t have a will or a revocable living trust, then when you die, your assets will go according to state law found in the probate code.

If you live in California it goes like this:

  • if you are married, your assets will go to your spouse.
  • If you have children, your separate assets will go either one-half to your spouse if you have one child, and one-third to your spouse if you have more than one child. The rest will go to your child(ren).

If you are not married and don?t have children, your assets will go to your next of kin in the following order:

  • to your parents, if they are alive, then
  • to your siblings, if they are alive, then
  • to your aunts and uncles, if they are alive, then
  • to your cousins, if they are alive, then
  • to your crazy fourth cousin twice removed, if he isn?t alive, then
  • to the state. Believe it or not (or course you can believe it) if? there are no living family members, the state will take your assets. The sophisticated legal term for this is ?escheat? ? your estate will escheat to the state.

You get the picture. If you don?t have a will or a revocable living trust which states how you want your assets distributed, you have what is called an Intestate estate. Intestate estates are distributed according to the state probate code.

Conservatorship

It?s bad enough to rely on the state to distribute your assets when you die, but it?s even worse to rely on the state to manage your assets while you are alive.

If you become incapacitated, which means you are no longer capable of managing your affairs, e.g. dementia, then someone else must manage your assets for you. For that someone to manage your assets, you must have already signed a Durable Power of Attorney.

A durable power of attorney is a document that gives the person you name the authority over your assets, like bank accounts and real property, if you become incapacitated. The person you name, your Agent, can take the durable power of attorney to your bank and get access to your accounts to take care of you ? pay your bills, etc.

However, if you did not sign a durable power of attorney, no one will have the authority to manage your affairs. And once you become incapacitated, it?s too late to sign a durable power of attorney because you are incapacitated. Incapacitated people cannot sign legal documents.

So now what? Your loved ones will have to hire an attorney and petition the court to appoint one of them or someone the court chooses as your Conservator. A conservator is a person authorized by the court to manage your affairs, and in many cases must submit an account of her activities to the court for the judge to review. It is an expensive, tedious and nightmarish solution, which could have been simply avoided if you had signed a durable power of attorney.

Bottom line: If you don?t have an estate plan, state law will determine who gets your stuff, and if you become incapacitated, the court may end op overseeing the management of your assets.
